A consecuencia de la pandemia muchos negocios se han visto obligados a permanecer cerrados o, en el supuesto de que hayan podido abrir, lo han hecho con severas restricciones que les han impedido incluso llegar a cubrir gastos debido a la limitación de aforos, de horarios, etc. En estos periodos de cierre, sin embargo, se ha dado el caso de que, pese a no poder tener actividad, los empresarios se han visto obligados a seguir pagando impuestos, entre ellos, el IAE o impuesto sobre actividades económicas.

El pasado 11 de enero de 2022, el Juzgado de lo Contencioso Administrativo número 3 de Valencia, dictó una sentencia, la 9/2022 (Rec 344/21), que abre la puerta a una interpretación jurisprudencial cuanto menos, esperanzadora para todos aquellos empresarios que han visto como, durante la pandemia, sus negocios y actividades económicas no han podido ser desarrolladas total o parcialmente.

Pese a no ser firme la sentencia, ya son diversas las empresas que han visto como los tribunales se pronunciaban a su favor y condenaban a la administración a devolver el importe del IAE proporcional al periodo que tuvieron que cerrar a causa de la pandemia.

Se abre la posibilidad a que todos aquellos negocios que durante la pandemia se vieron forzados al cierre –hoteles, salones de juego, casinos, bares y restaurantes, discotecas, etc.– bien por decreto o Real Decreto, tengan la posibilidad de recuperar los importes que tuvieron que declarar como Impuesto de Actividades Económicas en su parte proporcional al tiempo que se vieron inactivos en contra de voluntad o que vieron reducida su actividad.
