El Instituto de Contabilidad y Auditoría de Cuentas resuelve una consulta sobre el registro contable del impuesto turístico balear
Según se indica en la consulta, recogida en el último boletín del Instituto de Contabilidad y Auditoría de Cuentas (BOICAC 137), se trata de una sociedad inmobiliaria de renta vacacional que cobra a los huéspedes el impuesto turístico (IVA incluido) y en el período siguiente paga el impuesto a Hacienda y la cuestión que se plantea es si debe declarar el cobro del impuesto como un ingreso propio o como un cobro por cuenta de Hacienda, así como su contabilización.
Como ya se ha indicado, la contestación a la presente consulta se realiza desde un punto de vista contable, ya que este Instituto no tiene competencias sobre cuestiones de naturaleza fiscal, por lo que en lo que respecta a la declaración del impuesto deberá consultar con los organismos competentes de la Administración Tributaria, si bien se hará referencia a la normativa que regula dicho impuesto.
La Ley 2/2016, de 30 de marzo, del impuesto sobre estancias turísticas en las Illes Balears y de medidas de impulso del turismo sostenible, establece en sus artículos 4, 6, 11 y 14 lo siguiente:
Artículo 4. Hecho imponible.
1. Constituyen el hecho imponible del impuesto las estancias, por días o fracciones, con o sin pernoctación, que los contribuyentes realicen en las Illes Balears en los siguientes establecimientos turísticos:
a) Los establecimientos de alojamiento hotelero, eso es, los hoteles, los hoteles de ciudad, los hoteles apartamentos y los alojamientos de turismo de interior.
b) Los apartamentos turísticos.
c) Las diversas clases de alojamientos de turismo rural, eso es, los hoteles rurales y los agroturismos.
d) Los albergues y los refugios.
e) Las hospederías.
f) Los establecimientos explotados por las empresas turístico-residenciales, excepto con respecto a las unidades de alojamiento residencial.
g) Los hostales, los hostales-residencia, las pensiones, las posadas, las casas de huéspedes y los campamentos de turismo o campings.
h) Las viviendas turísticas de vacaciones, las viviendas objeto de comercialización de estancias turísticas y las viviendas objeto de comercialización turística susceptibles de inscripción de acuerdo con las leyes que las regulan.
i) El resto de establecimientos y viviendas a los que la normativa autonómica otorga la calificación de turísticos.
j) Las viviendas objeto de comercialización turística que no cumplan con los requisitos establecidos para ello en la normativa autonómica y que, por lo tanto, no sean susceptibles de inscripción de acuerdo con la legislación turística vigente.
k) Las embarcaciones de crucero turístico cuando realicen escala en un puerto de las Illes Balears. De acuerdo con ello, no se incluyen los inicios ni las llegadas de los cruceros con salida o destino final en las Illes Balears.
2. Los establecimientos y las viviendas objeto de comercialización turística que se indican en el apartado anterior son los que regula la Ley 8/2012, de 19 de julio, del turismo de las Illes Balears. (…)
3. A los efectos de la presente ley se entiende que las estancias en los establecimientos turísticos a que se refieren los apartados anteriores del presente artículo constituyen, en todo caso, estancias turísticas.
Artículo 6. Sujetos pasivos.
1. Son sujetos pasivos contribuyentes de este impuesto todas las personas físicas que llevan a cabo una estancia en los establecimientos turísticos a los que se refiere el artículo 4.1 de la presente ley.
En el caso particular de las embarcaciones de crucero turístico, se entienden por contribuyentes los pasajeros y las pasajeras que están en tránsito en el momento del devengo del impuesto.
En todo caso, se consideran representantes de los contribuyentes las personas jurídicas a cargo de las cuales se expida la factura o el documento análogo por razón de la estancia de personas físicas integrantes de la organización de la persona jurídica en los establecimientos turísticos.
2. Tienen la consideración de sujetos pasivos sustitutos del contribuyente y están obligadas a cumplir las obligaciones materiales y formales establecidas en la presente ley y en sus disposiciones de desarrollo, las personas físicas y jurídicas, así como las entidades sin personalidad jurídica a las que se refiere el artículo 35.4 de la Ley 58/2003, de 17 de diciembre, general tributaria, que son titulares de las empresas que explotan los establecimientos turísticos a los que se refiere el artículo 4.1 de la presente ley.
Artículo 11. Obligaciones formales del sustituto del contribuyente.
1. Serán obligaciones formales del sustituto del contribuyente las siguientes:
a) Presentar las declaraciones censales que se establezcan reglamentariamente relativas al inicio de la actividad de explotación de los establecimientos turísticos, a los elementos tributarios relevantes para la aplicación del impuesto y sus modificaciones, y al cese de la actividad de explotación.
b) Presentar las autoliquidaciones a las que se refiere el artículo 14 de la presente ley.
c) Expedir y entregar los justificantes de la exigencia y el cobro del impuesto al contribuyente.
d) Llevar los libros y los registros necesarios para recoger todas las circunstancias con relevancia tributaria inherentes a las estancias sujetas al impuesto, los justificantes a que se refiere la letra anterior, las exenciones y, en general, los diferentes elementos tributarios necesarios para la aplicación del impuesto.
e) Registrar las operaciones y demás elementos a los que se refiere la letra anterior en el plazo establecido para la liquidación y el pago del impuesto. (…)
Artículo 14. Gestión.
1. Las personas o las entidades titulares de la explotación de los establecimientos turísticos a los que se refiere el artículo 4.1 de la presente ley, en calidad de sustitutos del contribuyente, presentarán la autoliquidación o las autoliquidaciones y los ingresos a cuenta previstos en los apartados siguientes del presente artículo, en los términos y los plazos que se establezcan por decreto, que también podrá disponer que la presentación y, en su caso, el correspondiente pago tengan que realizarse obligatoriamente por medios telemáticos. (…).”
Según lo anterior y desde un punto de vista contable…
Una vez indicado lo anterior, y desde un punto de vista contable, hay que hacer referencia a la Resolución de este Instituto de 10 de febrero de 2021, por la que se dictan normas de registro, valoración y elaboración de las cuentas anuales para el reconocimiento de ingresos por la entrega de bienes y la prestación de servicios, que en su artículo 34 establece para los impuestos especiales, que presentan similitudes con el impuesto objeto de consulta, que deben quedar excluidos de la cifra de ventas y, por tanto, deben eliminarse a efectos del cálculo de la cifra anual de negocios del sujeto pasivo que venga obligado legalmente a repercutir a un tercero dichos impuestos.
Asimismo, la Norma de registro y valoración (NRV) 14ª. Ingresos por ventas y prestación de servicios, recogida en la segunda parte del Plan General de Contabilidad (PGC), aprobado por el Real Decreto 1514/2007, de 16 de noviembre, establece que los impuestos que gravan las operaciones de venta de bienes y prestación de servicios que la empresa debe repercutir a terceros como el impuesto sobre el valor añadido y los impuestos especiales, así como las cantidades recibidas por cuenta de terceros, no formarán parte de los ingresos.
En similares términos se pronuncia la NRV 16ª del Plan General de pequeñas y medianas empresas (PGC de PYMES), aprobado por Real Decreto 1515/2007 de 16 de noviembre.
Por tanto, a los efectos anteriores, podrá crear una subcuenta dentro del grupo 47. Administraciones Públicas, y en concreto de la cuenta 475. Hacienda Pública, acreedora por conceptos fiscales, que refleje adecuadamente la operación.
Respecto a la numeración y nombre de las cuentas a emplear para reflejar los débitos con la Administración Tributaria por los importes repercutidos, hay que tener en cuenta que, tal y como establece el PGC, no tendrán carácter vinculante los movimientos contables incluidos en su quinta parte y los aspectos relativos a numeración y denominación de cuentas incluidos en su cuarta parte, excepto en aquellos aspectos que contengan criterios de registro o valoración.
En cualquier caso, en la memoria de las cuentas anuales se facilitará toda la información significativa sobre la operación, de forma que aquellas en su conjunto reflejen la imagen fiel del patrimonio, la situación financiera y los resultados de la empresa.
