Aprobados los nuevos modelos de declaración del Impuesto sobre Sociedades (IS) y el Impuesto sobre la Renta de No Residentes (IRNR) 2024: principales novedades y cambios normativos
Publicación oficial y contexto normativo
El Boletín Oficial del Estado (BOE) ha publicado la Orden HAC/657/2025, de 21 de junio, que aprueba los modelos de declaración del Impuesto sobre Sociedades (IS) y del Impuesto sobre la Renta de no Residentes (IRNR) aplicables a establecimientos permanentes y entidades en régimen de atribución de rentas constituidas en el extranjero con presencia en España, correspondientes a periodos impositivos iniciados entre el 1 de enero y el 31 de diciembre de 2024. Además de los modelos, esta norma establece el procedimiento de declaración e ingreso, así como los requisitos técnicos para su presentación electrónica.
Incorporación de la autoliquidación rectificativa
Una de las principales novedades es la inclusión de la autoliquidación rectificativa, conforme a los recientes cambios normativos. Esta figura permite al contribuyente corregir una autoliquidación anterior utilizando un modelo normalizado. En particular, se adapta el modelo 200 para los periodos iniciados en 2024, incorporando nuevas casillas que facilitan dicha rectificación sin necesidad de iniciar un procedimiento de devolución de ingresos indebidos.
Cambios en la deducibilidad de gastos financieros
Se actualiza el apartado relativo a la “Limitación en la deducibilidad de gastos financieros. Art. 16 LIS”, en consonancia con lo dispuesto en la Ley 13/2023. Esta norma excluye de la determinación del beneficio operativo aquellos ingresos o gastos que, pese a formar parte de este concepto contable, no se integran en la base imponible del impuesto. Asimismo, se suprime la exclusión de ciertos fondos de titulización de la aplicación de esta limitación.
Nuevas exenciones y modificaciones en deducciones
Se amplía la relación de actividades exentas en el IS, incluyendo las de inserción sociolaboral de colectivos en riesgo de exclusión social y de educación de altas capacidades. También se aclaran los supuestos en los que las actividades de I+D+i quedan exentas.
En cuanto a las deducciones por donativos, se incrementa del 35 % al 40 % el porcentaje general, y hasta el 50 % si se cumple con la regla de mantenimiento de aportaciones durante tres años (antes eran cuatro). Además, se eleva el límite de la base deducible del 10 % al 15 % de la base imponible.
Incentivos fiscales a inversiones sostenibles y movilidad eléctrica
El Real Decreto-ley 8/2023 prorroga para 2024 la libertad de amortización para inversiones en instalaciones de autoconsumo energético que utilicen fuentes renovables y sustituyan a las de origen fósil.
Por su parte, el Real Decreto-ley 4/2024 introduce la amortización libre para inversiones en vehículos eléctricos nuevos (tipologías FCV, FCHV, BEV, REEV o PHEV) y puntos de recarga (privados o públicos), con efecto para los ejercicios 2024 y 2025. También mejora el régimen de reserva de capitalización, aumentando del 10 % al 15 % el porcentaje de reducción del incremento de fondos propios, y reduciendo de cinco a tres años los plazos de mantenimiento y de indisponibilidad de dicha reserva.
Cambios en regímenes fiscales especiales
Con efectos desde el 1 de enero de 2024, se modifican dos regímenes territoriales:
- Régimen especial de las Illes Balears: conforme al Reglamento aplicable hasta 2028, se desarrollan la reserva para inversiones y el tratamiento fiscal específico para empresas industriales, agrícolas, ganaderas y pesqueras.
- Régimen Económico y Fiscal de Canarias: se eliminan los límites temporales y se amplía el plazo de ejecución de las inversiones anticipadas.
Impacto de la Ley 7/2024 y la sentencia del TC
La Ley 7/2024, de 20 de diciembre, ha introducido varios cambios en los modelos fiscales, como:
- Consideración como gasto no deducible del Impuesto Complementario.
- Nuevos límites fiscales para grandes empresas con más de 20 millones de euros de cifra de negocio.
- Aplicación del régimen de consolidación fiscal con limitaciones suavizadas para fundaciones.
- Inclusión obligatoria y progresiva en la base imponible del IS de las pérdidas por deterioro de participaciones deducidas antes de 2013, conforme a la STC 11/2024.

Mejoras en el modelo 200 y nuevos medios de pago
La Agencia Tributaria ha introducido varias mejoras en el modelo 200, como la inclusión de datos sobre solicitud de abono, titularidad real, sociedades civiles y cooperativas. Además, se amplía la información exigida en el Balance y la Cuenta de Pérdidas y Ganancias, y se mantienen formularios anexos sobre correcciones relevantes, memoria anual de proyectos con bonificaciones, y reservas para inversiones en Canarias e Illes Balears.
Respecto a los métodos de pago, se incorporan nuevas opciones como el pago con tarjeta de crédito y transferencias inmediatas a través de plataformas de comercio electrónico seguro, ampliando así las vías tradicionales como domiciliación o NRC.
