El Tribunal General de la UE anula la sanción del Parlamento Europeo por acoso laboral a una ex-eurodiputada

Los antecedentes del compromiso europeo contra el acoso

El Parlamento Europeo ha demostrado históricamente una actitud activa frente a la lucha contra el acoso en el entorno laboral y político. Desde su Resolución 2001/2339 (INI), este organismo ha instado tanto a las instituciones comunitarias como a los Estados miembros a garantizar una protección efectiva frente al acoso moral, ya sea de naturaleza psíquica o sexual. Pese a ello, la propia institución no ha estado exenta de controversias. Un caso reciente lo demuestra: un exasesor de Junts denunció un doble acoso —psicológico y sexual— por parte de un eurodiputado, aunque este alegó que sus actos no fueron más que “bromas y comentarios más o menos oportunos tergiversados”.

Marco legal europeo sobre el acoso laboral

El Estatuto del Funcionariado de la Unión Europea, en su artículo 12 bis, recoge una regulación clara sobre el acoso. En su primer apartado, prohíbe expresamente cualquier forma de acoso psicológico o sexual. Añade que las víctimas o testigos que actúen de buena fe no deben sufrir represalias. Además, define “acoso psicológico” como toda conducta prolongada, reiterada y con intención, que atente contra la dignidad o integridad de una persona. Por su parte, el acoso sexual se configura como un comportamiento sexual no deseado que genere un ambiente intimidatorio u ofensivo, y se considera, además, una forma de discriminación por razón de género.

El comité consultivo del Parlamento y el procedimiento sancionador

Para gestionar las denuncias de acoso dentro del Parlamento Europeo, existe un Comité Consultivo encargado de instruir el procedimiento administrativo establecido en el protocolo correspondiente. Este órgano desempeña un papel clave en la investigación y valoración de las quejas, basándose en la información recopilada y en los testimonios recogidos.

Anulación judicial de la sanción a una exeurodiputada

El Tribunal General de la Unión Europea, mediante la Sentencia de 12 de marzo de 2025 (Sala cuarta ampliada), asunto T-349/23, anuló dos decisiones adoptadas por la presidenta del Parlamento el 17 de abril de 2023. En dichas decisiones se determinó que ciertos comportamientos de una exeurodiputada constituían acoso laboral, imponiéndosele la sanción de pérdida del derecho a dietas por estancia durante diez días. Sin embargo, el Tribunal concluyó que durante el procedimiento, la acusada no tuvo acceso ni a un resumen de los testimonios clave ni a los documentos probatorios —como correos electrónicos o mensajes— en los que se basaban las acusaciones (apartado 60), lo que vulneró su derecho de defensa.

Requisitos mínimos para salvaguardar los derechos de la defensa

Según la doctrina jurisprudencial europea, cuando se activa el protocolo de acoso, la persona denunciada debe tener acceso, al menos, a un resumen del contenido esencial de los testimonios utilizados por el Comité Consultivo. Esta comunicación debe respetar la confidencialidad, recurriendo, si es necesario, a medidas como la anonimización o la divulgación parcial de los testimonios (véanse, entre otras, la Sentencia de 1 de septiembre de 2021, KN/CESE, T‑377/20 y la Sentencia del TJUE de 25 de junio de 2020, HF/Parlamento, C‑570/19, ap. 66).

Entre la protección de la salud laboral y el régimen disciplinario

Este asunto no es sólo una cuestión jurídico-técnica. En realidad, ilustra una problemática habitual también en España: la confusión entre protocolos de acoso como herramienta de prevención de riesgos psicosociales y su consideración como parte de un régimen disciplinario. Aunque ambos procedimientos pueden derivar de los mismos hechos, sus enfoques y exigencias legales difieren. Mientras que en el ámbito de la salud laboral se prioriza una intervención rápida y eficaz, en el ámbito disciplinario se exige una rigurosa garantía de los derechos procesales del acusado.

Necesidad de distinguir los marcos de actuación

Los protocolos de acoso laboral deben verse, ante todo, como mecanismos de protección de la salud en el trabajo. Si bien pueden derivar en sanciones disciplinarias, estas deben abordarse posteriormente conforme a las exigencias legales correspondientes. Pretender aplicar desde el inicio las garantías propias del derecho sancionador puede entorpecer la eficacia preventiva de los protocolos. La sentencia comentada refuerza la necesidad de encontrar un equilibrio justo entre el derecho de defensa y la protección de las víctimas y testigos.
