Ya han quedado equiparadas a efectos de cotización la jornada laboral completa y la parcial y con efectos retroactivos
La igualación de los beneficios de cotización entre trabajadores a tiempo parcial y a tiempo completo se ha oficializado y se aplicará retroactivamente a lo largo de toda la vida laboral de los trabajadores. Esta medida está previsto que:
- acelere el acceso a las pensiones y prestaciones de la Seguridad Social para aquellos empleados con contratos de trabajo a tiempo parcial, puesto que ya no será necesario trabajar dos días para que cuente como uno;
- tenga un impacto positivo en la brecha de género laboral, dado que hay que tener en cuenta que alrededor del 80% de los trabajadores a tiempo parcial son mujeres.
Modificaciones de la Ley de la Seguridad Social
Desde el 1 de octubre, la modificación del artículo 247 de la Ley de la Seguridad Social está en vigor, como parte de la reforma de las pensiones. A partir de este mes, por tanto, la cotización por trabajo a tiempo parcial se contabiliza de la misma manera que la de tiempo completo para fines de derechos a prestaciones como jubilación, incapacidad permanente o temporal, viudedad, orfandad o nacimiento y cuidado de menores. El Gobierno estima que alrededor de dos millones de trabajadores se beneficiarán de esta medida, la mayoría de los cuales son mujeres.
La modificación tiene en cuenta todos los períodos durante los cuales un trabajador ha estado empleado a tiempo parcial, sin importar la duración de la jornada laboral en cada uno de ellos, para cumplir con los requisitos de cotización necesarios para acceder a las prestaciones de jubilación (un mínimo de 15 años cotizados, con al menos 2 años dentro de ese período), o a las pensiones y prestaciones.
La norma también actualiza el artículo 248 de la Ley de Seguridad Social. En el apartado 1, se aclaran las condiciones para los trabajadores fijos discontinuos (considerados trabajadores a tiempo parcial para la Seguridad Social) en relación con la determinación de la base reguladora diaria de la prestación por incapacidad temporal. Esto garantiza un cálculo justo de las prestaciones para quienes trabajan de esta manera.
Cambios con origen en pronunciamientos del Tribunal Constitucional
Estos cambios son resultado de la jurisprudencia emanada de sentencias del Tribunal Constitucional, que declararon la inconstitucionalidad de ciertas disposiciones que afectaban negativamente a las pensiones de los trabajadores a tiempo parcial, en su mayoría mujeres. El coeficiente de parcialidad, que se consideraba ilegal, afectaba tanto al cálculo de los períodos mínimos de cotización requeridos como al porcentaje aplicado a la base reguladora para calcular la pensión de jubilación.
Aunque la Seguridad Social aplicó esta jurisprudencia desde su promulgación, la reforma de las pensiones de 2023 fue necesaria para actualizar la Ley General de la Seguridad Social. El Instituto Nacional de la Seguridad Social (INSS) ha confirmado que este cambio se aplicará con efecto retroactivo a toda la vida laboral de los trabajadores afectados. Por lo tanto, el impacto de esta modificación será inmediato para la población activa que se acerca a la jubilación, garantizando un cálculo justo de sus derechos de pensión. Por ejemplo, un trabajador de 63 años con 38 años cotizados, incluyendo algunos años a tiempo parcial, podrá acceder a la jubilación sin obstáculos. Esta medida equipara los derechos de los trabajadores, sin afectar a la prestación pública que recibirán en el futuro, que se calcula en función de sus contribuciones a la Seguridad Social a lo largo de su vida laboral.
