Inicio de los Trámites y Resolución Final
En el proceso de ratificación de la solicitud de residencia temporal para trabajar por cuenta ajena, el Tribunal Superior de Xustiza de Galicia (TSXG) ha reconocido el derecho de una ciudadana marroquí a obtener dicha autorización, para desempeñarse como ayudante de cocina en un restaurante árabe-marroquí en Pontevedra. Este fallo confirma la decisión inicial del Juzgado de lo Contencioso-administrativo número 2 de Pontevedra, que también había fallado a favor de la empleada.
Certificación de la Situación Nacional de Empleo
El proceso comenzó con la certificación del Servicio Público de Empleo (SEPE), que determinó la inexistencia de candidatos idóneos en el mercado laboral nacional para cubrir el puesto ofertado. Según el artículo 65.2 del Real Decreto 557/2011, este es un requisito indispensable para permitir la contratación de trabajadores extranjeros en ocupaciones que no están clasificadas como de difícil cobertura. El Real Decreto estipula que, en tales casos, es esencial que la Oficina de Extranjería considere tanto el informe del SEPE como la urgencia de la contratación.
Proceso de Selección y Decisión del Tribunal
El TSXG, al analizar el caso, señaló que el empleador presentó una oferta de empleo clara y ajustada a las necesidades del puesto, sin incluir requisitos que no estuvieran relacionados con el desempeño de las funciones. A pesar de que se contactó con seis candidatos, todos fueron descartados por razones justificadas, como la falta de experiencia en hostelería o conocimientos insuficientes en cocina.
El tribunal también abordó la Orden TAS/1745/2005, que exige que las ofertas de empleo no incluyan requisitos discriminatorios. En este caso, el dominio del idioma árabe o marroquí, exigido para el puesto, no fue considerado discriminatorio, sino lógico y pertinente dado el tipo de negocio. Ninguno de los candidatos fue rechazado por no cumplir con este requisito, lo que refuerza la legitimidad del proceso.
Aportación de Certificados y Ratificación
Además, se presentó un certificado del 15 de agosto de 2023, que acreditaba la inscripción de la trabajadora en el Registro Nacional de Artesanía para los Artesanos del Reino de Marruecos, en la actividad de servicios artesanales de catering, lo que respaldó aún más la solicitud.
Finalmente, el TSXG concluyó que se cumplieron todos los requisitos legales para la concesión de la residencia temporal, y confirmó el fallo a favor de la trabajadora marroquí. Cabe destacar que la sentencia no es firme, ya que aún puede ser recurrida en casación.
