A partir de junio de 2025 en vigor el sistema electrónico automatizado de tramitación de altas y bajas de trabajadores en la Seguridad Social
A partir del 1 de junio de 2025, la Seguridad Social implementará un nuevo sistema de tramitación electrónica automatizada para gestionar las altas y bajas de trabajadores. Esta medida se recoge en la Resolución de 9 de abril de 2025 de la Tesorería General de la Seguridad Social, publicada en el BOE de 21 de abril de 2025, con el fin de agilizar y digitalizar los procesos administrativos en el ámbito laboral.
Marco normativo
La resolución que establece el nuevo sistema encuentra respaldo legal en el artículo 41.1 de la Ley 40/2015, de Régimen Jurídico del Sector Público, que define la actuación administrativa automatizada como aquella realizada íntegramente por medios electrónicos, sin intervención directa de personal público. Asimismo, se refiere al artículo 130 del Texto Refundido de la Ley General de la Seguridad Social, donde ya se contemplaba la posibilidad de emitir resoluciones automatizadas en procedimientos llevados a cabo por la Tesorería General.
Procedimientos incluidos y exclusiones
Las resoluciones automatizadas se aplicarán a diversos procedimientos de altas y bajas de trabajadores, aunque quedan excluidos determinados regímenes especiales. En concreto, no se aplicará a los empleados de hogar ni a trabajadores agrarios durante sus períodos de inactividad. Esta delimitación garantiza que la automatización se adapte a modalidades laborales donde las condiciones administrativas lo permitan.
Sistema de firma electrónica y autenticación
El nuevo procedimiento se respaldará mediante un sistema de firma electrónica basado en un sello electrónico de la Tesorería General de la Seguridad Social. Este instrumento servirá para realizar de forma automatizada todos los trámites asociados a los servicios comunes de la Seguridad Social integrados en la sede electrónica de la Secretaría de Estado de la Seguridad Social y Pensiones. También se utilizará en cualquier actuación que requiera identificación o autenticación electrónica en el marco de la administración automatizada.
Publicación y recursos disponibles
Conforme al Real Decreto 203/2021, que regula la actuación del sector público por medios electrónicos, toda resolución de carácter automatizado debe publicarse en la sede electrónica correspondiente.
Los interesados podrán presentar recurso de alzada ante la dirección provincial competente en el plazo de un mes desde la notificación del acto. En caso de que se impugnen resoluciones administrativas automatizadas, se considerará que estas han sido adoptadas por los directores de las administraciones de la Seguridad Social correspondientes al código de cuenta de cotización del empleador afectado. Esta previsión garantiza la atribución clara de responsabilidad jurídica en el marco de actuaciones electrónicas.
Definición de estándares y calidad del sistema
La resolución también contempla la necesidad de establecer protocolos que garanticen la calidad técnica y operativa del sistema de automatización. La Subdirección General de Afiliación, Cotización y Recaudación en Periodo Voluntario será la encargada de definir las especificaciones del sistema, mientras que la Gerencia de Informática de la Seguridad Social asumirá funciones de diseño, programación y supervisión de la plataforma.
