¿Qué es un autónomo societario?

Se define a un autónomo societario como la persona que ha constituido una sociedad mercantil con persona jurídica para desarrollar su actividad.

Hasta el año 2020 no existía lo que ha dado en llamarse la famosa “tarifa plana”, es decir, las bonificaciones en las cuotas a la seguridad social o tarifa recudica, para este tipo de profesionales.

Cómo solicitarla

Se deben cumplir una serie de requisitos principales para disfrutar de la reducción de la cuota de autónomo societario y estos son:

  • No tener deudas pendientes con la Seguridad Social o la Agencia Tributaria.
  • Darse de alta por primera vez en el régimen especial de trabajadores autónomos (RETA).
  • En caso de trabajadores que ya estuvieran de alta en el RETA: que hayan transcurrido al menos dos años de su última alta en el régimen especial de trabajadores autónomos (RETA), o bien que hayan transcurrido 3 años en caso de haber disfrutado cualquier otra bonificación.

Las bases de cotización

El autónomo societario tendrá que elegir para este año 2022 su base de cotización, lo que determinará el importe que deba satisfacer mensualmente a la Seguridad Social.

La base mínima de cotización está fijada en 1.234,86 €, y si se opta por ella, la tarifa plana es de aproximadamente 85 € durante el primer año.

Además, después del primer año la cuota de autónomo societario es bonificada en un 50% desde el mes 12 al 18 y del 30% desde el mes 18 al 24.

Así, la tarifa plana de un autónomo societario supone un ahorro de 3.514,44 € el primer año; 1.133,61 € del mes 12 al 18 y 680,16 € del mes 18 al 24.

Tarifa retroactiva

Pese a que la “tarifa plana” fue aprobada en el año 2013, no fue hasta el año 2020 cuando los autónomos societarios han podido efectivamente disfrutarla. Por este retraso, todos los que cumplieran con los requisitos para ello pero no hayan podido disfrutar la tarifa plana, habiendo pagado de más en sus cuotas (por no haber podido acceder a la bonificación), pueden reclamar como ingresos indebidos a la Tesorería General de la Seguridad Social (TGSS).
