El marketing a empresas a través de redes sociales está sujeto al Impuesto sobre el Valor Añadido al tipo impositivo general del 21%; constituyendo una generación de rendimientos de actividad económica profesional, por la que habrá obligación de retener al tipo del 15%

Consulta Vinculante V1417-20, de 14 de Mayo de 2020, ante la Dirección General de Tributos en relación al Impuestos sobre la Renta de las Personas Físicas.

El marketing a empresas a través de redes sociales (Instagram, Facebook, Youtube, Blogs, etc,), esto es, el servicio que prestan los denominados «creadores de contenido digital», consistente en la selección, gestión y soporte fotografías y/o vídeos para la promoción de marcas o servicios está sujeta al Impuesto sobre el Valor Añadido al tipo impositivo general del 21 por ciento.

Y en el Impuesto sobre la Renta de las Personas Físicas, entendiendo que los “creadores de contenido digital” se corresponden con los coloquialmente denominados “influencers”, personas físicas que operan en internet a través de redes sociales marcando tendencias que inciden en el consumo, por lo que las marcas comerciales están interesadas en publicitarse a través de ellos, se está ante la generación de rendimientos de actividad económica —profesional— , con obligación de retener al tipo del 15% (o del 7% en los dos años siguientes al inicio de la actividad).

No obstante, el tipo de retención aplicable debe matizarse respecto a los rendimientos que la consultante pudiera satisfacer a los “influencers por la cesión por estos de derechos de imagen, pues en tal caso el sometimiento a retención de los importes que aquella abona en la parte que efectivamente se correspondiera con esa cesión ya no lo sería como rendimientos de la actividad profesional desarrollada, sino que estarían sometidos a retención —con independencia de su calificación, que mantendría la de rendimientos de actividad profesional— como rendimientos procedentes de la cesión del derecho a la explotación del derecho de imagen, lo que comportaría la sujeción de esta parte al tipo del 24%.
