Confirmada por el TSJIB la incapacidad permanente total a un ayudante de cocina con limitaciones en una pierna tras sufrir un accidente de moto

El TSJIB señala que sus dolencias no son compatibles con un trabajo “de corte físico y bipedestación prolongada”

La sala de lo Social del Tribunal Superior de Justicia de Illes Balears (TSJIB) ha ratificado, en sentencia del pasado 2 de diciembre de 2024, la decisión de un juzgado Social de Palma que declaró la incapacidad permanente total a un ayudante de cocina que padece varias limitaciones funcionales provocadas por un accidente de moto.

El demandante sufrió un accidente de moto el 14 de febrero de 2021 que le causó diversas lesiones en una pierna que motivaron su baja temporal. El suceso le provocó un cuadro de artrosis postraumática severa con su consiguiente menoscabo funcional. El juzgado declaró al actor en situación de incapacidad permanente total para su profesión de cocinero con derecho a percibir una pensión vitalicia del 55% de su base reguladora mensual de 1.362,99 euros con efecto desde el 19 de enero de 2023.

El tribunal avala el razonamiento de la magistrada de instancia en el que poniendo en relación las dolencias con las funciones esenciales de su profesión de ayudante de cocina, “que es de corte físico, requiere bipedestación prolongada y movimientos forzados durante toda la jornada laboral, se concluye que las mismas inhabilitan para su adecuado y normal desempeño con el mínimo rendimiento y profesionalidad exigibles«.
