La ministra de Empleo y Seguridad social ha redactado un informe sobre el Anteproyecto de Ley que modifica y actualiza la normativa en materia de autoempleo. Estos cambios pretenden aumentar y fomentar el autoempleo.
El nuevo anteproyecto de ley amplía incentivos ya existentes a otros colectivos y pone en marcha nuevas medidas para impulsar el autoempleo, ya sea individual o colectivo, y apoya el trabajo autónomo y la Economía Social.
Actualmente, en España, los autónomos suponen el 18’6% del total de los trabajadores dados de alta en la Seguridad Social, (más de 3 millones de trabajadores por cuenta propia).
El año pasado, el número de autónomos creció en casi 75.500 personas, y desde 2011 vemos un incremento considerable de afiliados a la Seguridad Social como trabajadores por cuenta propia. No solamente generan trabajos para sí mismos, si no que el número de asalariados contratados por autónomos no deja de aumentar desde hace 3 años.
Para continuar impulsando el emprendimiento y facilitar que los autónomos puedan seguir generando empleo, desde el ministerio de Empleo se proponen modificaciones y actualizaciones de la ley de emprendedores:
Ampliación de la Tarifa Plana:
El nuevo anteproyecto de ley introduce novedades en la Tarifa Plana para Autónomos.
- La cuota de los 6 primeros meses se fija en 50€.
- Se amplía el incentivo a los autónomos que se dan de alta y posteriormente contraten a trabajadores por cuenta ajena.
- Se extiende la Tarifa Plana Especialmente Protegida a las víctimas del terrorismo y la violencia de género.
- Se amplían los incentivos a personas con discapacidad independientemente de su edad.
Se podrá disfrutar de la cotización reducida a 50 € los primeros 6 meses o reducción de la cotización de la Seguridad Social del 80%. Los 6 meses siguientes el autónomo se reducirá el 50% de la cuota y después de un año, los siguientes 6 meses podrá disfrutar del 30% de reducción de la cuota. (18 meses en el caso de los menores de 30 o 35 si son mujeres).
Extensión de la capitalización de la prestación por desempleo:
Para ayudar a las personas que quieren emprender se extienderá, independientemente de la edad del solicitante, la posibilidad de capitalizar el 100% del paro, para facilitar la inversión y los gastos iniciales en una actividad emprendedora.
Estas serán las formas de capitalizar el paro:
- Capitalizar el 100% en un único pago.
- Capitalizar sólo una parte y utilizar el resto para el abono de cuotas a la Seguridad Social.
- Destinar el total de la prestación al abono de las cuotas mensuales.
Una de las novedades en este apartados es la posibilidad de utilizar la capitalización del paro para cubrir los gastos de constitución de una nueva sociedad, para adquirir servicios de asesoramiento, formación e información, pudiendo invertir hasta el 15% de la cantidad utilizada en estos procesos.
Otras medidas relacionadas con la prestación por desempleo son:
- Compatibilidad entre el paro y darse de alta en el RETA durante 270 días como máximo.
- Ampliación del plazo desde los 24 hasta los 60 meses para la reanudación de la prestación por desempleo a todos los trabajadores con derecho a prestación que realice un trabajo por cuenta propia. (En el caso de reanudad la prestación por desempleo a partir del mes 24, el autónomo deberá acreditar causas económicas u organizativas).
Ampliación de los incentivos a los familiares colaboradores:
En el nuevo anteproyecto de ley también se ampliará la bonificación a los familiares colaboradores de forma que, a partir de la entrada en vigor de dichas modificaciones y actualizaciones, podrán disfrutar de una bonificación en las cuotas de la Seguridad Social durante 2 años, por el que después de la bonificación del 50% de las cuotas de la Seguridad Social durante los 18 primeros meses, los 6 restantes supondrán una bonificación del 25% de la cuota para evitar el “efecto escalón” en el abono de las cotizaciones.
Autónomos Económicamente Dependientes:
Para este tipo de autónomos, la ley se modificará en el anteproyecto de ley, a favor de la conciliación de la vida familiar y profesional por lo que toman mayor importancia el riesgo durante el embarazo y la lactancia de un menos de nueve meses, descansos por maternidad, paternidad, adopción o acogimiento, cuidado de menos de siete años a cargo y por familiares en situación de dependencia o discapacidad igual o superior al 33%.
