El Govern Balear ha publicado una nueva instrucción (haz clic en los siguientes enlaces para ver la norma publicada en el Boletín Oficial balear en castellano o en catalán) en la que ordena cómo deben actuar las empresas en ERTE con los trabajadores fijos discontinuos y desde Moya & Emery queremos recordar que incumplir esta instrucción puede salir muy caro en forma de sanciones.
El contenido de la instrucción, que consta de un artículo principal señala «[…] y para reafirmar las medidas protectoras y de salvaguarda del empleo para los trabajadores fijos discontinuos incluidos en expedientes de regulación temporal de empleo, se considera necesario dictar la siguiente,
Instrucción
- Mantener a los trabajadores afectados, inclusive a los trabajadores fijos discontinuos, en el ERTE hasta la finalización de su vigencia, salvo previa incorporación efectiva al puesto de trabajo, si las empresas que han tramitado un expediente de regulación temporal de empleo continúan afectadas por las causas relacionadas con la COVID-19, derivadas de los artículos 22 y 23 del Real Decreto Ley 8/2020.
La persistencia en la actualidad de las causas que han motivado la tramitación de los ERTE (restricciones de actividad, limitaciones de aforo, ausencia de demanda de actividad, etc.), implica que las empresas no pueden recurrir a medidas de afectación de la relación laboral de los trabajadores fijos discontinuos distintas a las de los expedientes de regulación temporal de empleo. En caso contrario, la empresa incurriría en incumplimiento de la disposición adicional sexta del Real Decreto Ley 8/2020, con las consecuencias jurídicas previstas en ella, al haberse beneficiado indebidamente de medidas extraordinarias en materia de Seguridad Social.«
