Podíamos leer en elEconomista.es, haciéndose eco a su vez de la noticia publicada por Europa Press, que el despido será nulo (y dejará, por tanto, de ser considerado un despido improcedente, que es lo que ahora sucede) cuando el empresario extinga un contrato temporal sin causa justificada, según ha planteado el Gobierno en el borrador o propuesta presentada a los agentes sociales en el marco de las negociaciones de la reforma laboral. La consecuencia más importante de calificación de un despido como nulo es que conlleva la obligación de readmitir al trabajador de forma inmediata y, además, la obligación por parte del empleador de abonar los salarios atrasados. Además, se plantea que sólo cabrán los contratos temporales cuando existan picos en la demanda o vengan justificado por la necesidad de una sustitución.
El Gobierno ha propuesto a los agentes sociales que el despido de los trabajadores con contrato de duración determinada sea considerado nulo, en lugar de improcedente, si dicho contrato no está debidamente justificado o no se ha realizado por escrito, y todo ello con independencia de la causa que alegue la empresa para extinguir la relación laboral.
Así figura en el borrador, con fecha 2 de junio y al que ha tenido acceso Europa Press, que el Ejecutivo ha puesto sobre la mesa que aborda una parte de la reforma del mercado laboral, la referida a los contratos temporales, los convenios colectivos y la subcontratación.
La calificación de despido nulo de los contratados bajo una modalidad de duración determinada no justificada implicaría la readmisión inmediata del trabajador, con abono de los salarios dejados de percibir.
Lo que hace el Ejecutivo en el borrador es proponer la adición de un nuevo apartado en el artículo 55 del Estatuto de los Trabajadores en la parte relativa al despido nulo para el caso de los trabajadores que hayan suscrito un contrato de duración determinada no justificado.
