Sistema SII: Preguntas sobre Cuestiones Generales (parte 1 de 2)

Como ya te comentamos en anteriores actualizaciones de nuestro blog, con las medidas aprobadas en el ámbito tributario, se incorpora el Sistema de Suministro de Información Inmediata (Sistema SII). Para facilitar las cosas a las empresas, la Agencia Tributaria se ha encargado de responder algunas preguntas para que las empresas tengan un poco más claro como adaptarse al nuevo Sistema SII.

Como estás respuestas a preguntas frecuentes son varias, fraccionaremos la información para que no se haga tediosa la lectura. En el artículo de hoy comentaremos algunas preguntas sobre las «Cuestiones Generales» que terminaremos de abordar en el artículo de mañana.  En el siguiente post abordaremos las preguntas sobre el «Registro».

Analizamos algunas de las Cuestiones Generales sobre el Sistema SII:

  1. ¿Qué es el Suministro Inmediato de Información (SII)?: Se trata de un nuevo sistema de llevanza de los libros de registro del IVA a través de la Sede Electrónica de la AEAT. La información se suministra de forma casi inmediata, de ahí su nombre.
  2. ¿Por qué se implanta el Suministro Inmediato de Información?: Gracias a las nuevas tecnologías y también debido a las reformas que se implementaron en la Ley 39/2015 de 1 de octubre de Procedimiento Administrativo Común de las Administraciones Públicas. En ella se implantan los medios electrónicos como forma preferente de comunicación entre las Administraciones Públicas y los contribuyentes.
  3. ¿Afecta el Sistema SII a todos los sujetos pasivos del IVA?: No, es obligatorio para cierto grupo y opcional para los otros. Los obligados a utilizar el Sistema SII serán los inscrito en el REDEME, las Grandes Empresas con una facturación superior a los 6 millones de euros y los Grupos de IVA
  4. ¿Se puede renunciar al Sistema SII?: Hay un caso que se especifica en las preguntas frecuentes de la Agencia Tributaria y son los inscritos en el REDEME. Estos podrán renunciar al uso del Sistema SII, ya que se ha previsto aprobar un plazo extraordinario para renunciar a este sistema durante el mes de Junio de 2017.
  5. ¿Se aplica el Sistema SII a los empresarios o profesionales que no estén en el territorio de aplicación del Impuesto Español?: Todos aquellos empresarios o profesionales que no se encuentren en el territorio de aplicación del Impuesto pero que tengan la condición de sujetos pasivos con un periodo de liquidación del IVA mensual, estarán obligados a llevar los libros de registro de IVA con el Sistema SII. Como siempre, se podrán acoger al Sistema SII todos aquellos que quieran hacerlo de forma voluntaria.
  6. ¿Como acogerse al Sistema SII de forma voluntaria?:  Se puede optar por el Sistema SII en la declaración censal (modelo 036) en el mes de noviembre anterior al inicio del año natural en el que deba surtir efecto, o también al tiempo de presentar la declaración de comienzo de actividad, que tendrá efecto en el año natural en curso. Para poder optar por el Sistema SII por primera vez se podrá hacer en el mes de Junio de 2017. Esta opción implica necesariamente liquidar el IVA de forma mensual.
  7. ¿Existe un mínimo de permanencia al Sistema SII?: Sí, un año natural.
  8. ¿Una vez acogido al Sistema SII, se puede renunciar?: Después de haber cumplido el plazo de permanencia mínimo, se podrá renunciar al Sistema SII en la declaración censal (modelo 036) en el mes de noviembre anterior al inicio del año natural en el que tendrá efecto.
  9. ¿Existe algún supuesto de exclusión o cese en el Sistema SII?: Siempre y cuando no se tenga un periodo de liquidación mensual, la exclusión del REDEME supone la exclusión del Sistema SII. También el cese en el régimen especial del grupo de entidades produce las mismas circunstancias. En los casos en los que los sujetos pasivos queden excluidos, tendrán que presentar de forma obligatoria los modelo 347 y 390.
  10. ¿Cuáles son las líneas básicas de funcionamiento del Sistema SII?: Para aquellos que se acojan al Sistema SII deberán presentar: El libro de registro de Facturas Expedidas, el libro de registro de Facturas Recibidas, el Libro de registro de Bienes de Inversión y el Libro de Registro de Determinadas Operaciones Intracomunitarias. Se deberán remitir a la Agencia Tributaria los detalles de la facturación donde se irá configurando casi en tiempo real la información. Esta información se enviará por formato XML pero también se podrá realizar a través de un formulario web para casos concretos o aquellos que lleven a cabo pocas operaciones.
  11. ¿Hay que enviar las facturas a la AEAT?: No, lo que hay que enviar son los campos de los registros de facturación que se concreten en la correspondiente Orden Ministerial.
  12. ¿Cuándo hay que enviar los registros de facturación a la AEAT?: En el caso de Facturas Expedidas: El plazo será de 4 días naturales desde la expedición de la factura, salvo que se trate de facturas expedidas por el destinatario o por un tercero, en estos casos el plazo será de 8 días naturales.  En el caso de Facturas Recibidas: El plazo es de 4 días naturales desde la fecha en que se produzca el registro contable de la factura, y como máximo antes del día 16 del mes siguiente al periodo de liquidación en que se hayan incluido las operaciones correspondientes. En el caso de operaciones de importación, estos 4 días deberán contar desde que se produzca el registro contable del documento en el que conste la cuota liquidada por las aduanas, y como en el caso anterior antes del día 16 del mes siguiente al final del periodo al que se refiera la declaración en la que se hayan incluido. En el caso de Operaciones Intracomunitarias: El plazo es de 4 días naturales, desde el momento de inicio de la expedición o transporte, o en el caso que sea así, desde el momento de la recepción de los bienes a que se refieren. En los casos de Información sobre Bienes de Inversión: Dentro del plazo de presentación del último periodo de liquidación del año (hasta el 30 de enero).

PLAZOS DURANTE EL SEGUNDO SEMESTRE DE 2017: Durante el 2º semestre del año 2017 el lazo de 4 días se amplía a 8 días naturales.
CÓMPUTO DE PLAZOS: De estos 4 u 8 días naturales se excluirán los sábados, los domingos y los declarados festivos nacionales.
