Para comenzar una actividad, el autónomo necesita realizar una serie de trámite, entre ellos se encuentra la solicitud de licencias, que dependiendo de la actividad del negocio variarán. Estos trámites se realizan en el Ayuntamiento donde se vaya a desempeñar la actividad. Hablaremos de las licencias más habituales:
- Licencia de actividades, instalaciones y obras: Esta licencia debe pedirse cuando la actividad se vaya a desarrollar ya sea en una vivienda, oficina, local, almacén, etc. Se necesita la licencia urbanística municipal que debe aprobar el consistorio en el que se ubique el negocio.
- Licencia de funcionamiento: El objetivo de este tipo de licencia es autorizar la puesta en uso de las instalaciones, locales o edificios después de que se realizar los trámites pertinentes que aprueben que reúnen las condiciones precisas en cuanto a licencias de actividades e instalaciones. Para poder tener esta licencia en orden, el espacio deberá estar finalizado y apto según las condiciones ambientales y urbanísticas que marque el ayuntamiento. ¿Quiénes deben tener licencia de funcionamiento? Todas aquellas actividades definidas como “calificada”. También deberá tener licencia de funcionamiento todas aquellas actividades insalubres, molestas y peligrosas que necesiten adoptar medidas correctivas de seguridad, sanitarias y medioambientales.
¿Cómo hacer una solicitud de licencia?
- Procedimiento ordinario: según el tipo de proyecto técnico puede ser común (si requiere proyecto de obras de edificación) o abreviado. Es necesario para llevar a cabo las obras precisas para la puesta en marcha de la actividad o su modificación.
- Implantación o modificación de actividades: hace referencia a las actividades que precisen de algún documento técnico requerido por la normativa sectorial o que se encuentren en el Catálogo de la Ley de Espectáculos Públicos y Actividades Recreativas.
- Comunicación Previa: para aquellas actividades que no precise de documento técnicos y se realicen obras de pequeño tamaño.
- Declaración Responsable: el titular de la actividad subscribe un documento a través del cual reconoce cumplir con los requisitos sectoriales y urbanísticos que obliga la normativa vigente para ejercer la actividad empresarial, comprometiéndose además a cumplirla durante el tiempo que desarrolle la tarea.
