El TJUE se pronuncia

El Tribunal de Justicia de la Unión Europea (TJUE) ha dictado una relevante sentencia en el asunto C-300/23 que aborda la transparencia y posible abusividad de las cláusulas hipotecarias que utilizan el Índice de Referencia de Préstamos Hipotecarios (IRPH). Este fallo establece las condiciones bajo las cuales dichas cláusulas pueden ser declaradas nulas y proporciona guía sobre los derechos de los consumidores y las obligaciones de las entidades financieras. La decisión responde a una cuestión prejudicial planteada por el Juzgado de Primera Instancia n.º 8 de San Sebastián, en el marco de una demanda contra Kutxabank.

Contexto del IRPH y los préstamos hipotecarios

El IRPH se basa en la media simple de los tipos de interés ponderados por los principales de operaciones hipotecarias realizadas por entidades financieras. Requisito de transparencia según el TJUE

El TJUE destaca que el sistema de protección al consumidor establecido por la Directiva 93/13 impone una interpretación amplia del requisito de transparencia. El TJUE subraya que la posible abusividad de la cláusula depende del incumplimiento del requisito de transparencia y de un eventual desequilibrio significativo en perjuicio del consumidor. Entre los factores a considerar se encuentran:

Consecuencias de una declaración de abusividad

En caso de que una cláusula IRPH sea declarada abusiva, el TJUE establece que los jueces nacionales pueden sustituirla por una disposición supletoria de derecho nacional siempre que esta tenga un alcance equivalente. Sin embargo, no es posible modificar la cláusula para remediar el desequilibrio generado. Además, si el contrato no puede subsistir sin la cláusula declarada abusiva, el derecho comunitario impide que el banco reclame la totalidad del capital prestado junto con intereses calculados desde el momento de su concesión.
